August 2012 zur Frage Stellung genommen, ob man w\u00e4hrend der Arbeitszeit einen \u00e4rztlichen Termin wahrnehmen darf. Art. 20 GAV (Abs. 2 bis 6) z\u00e4hlt die Gr\u00fcnde f\u00fcr einen bezahlten Kurzurlaub abschliessend auf. Der Arztbesuch z\u00e4hlt nicht dazu.<br \/>\nErg\u00e4nzend h\u00e4lt Art. 20.1 GAV fest, dass ein Urlaub beantragen muss, wer die Arbeit aus einem anderen Grund als Ferien, Krankheit, Unfall, Schwangerschaft, Mutterschaft oder Milit\u00e4rdienst aussetzen will. In Art. 26 GAV wird die Lohnfortzahlung bei Krankheit oder Unfall geregelt.<br \/>\nDer Besuch eines Arztes kann tats\u00e4chlich ein Hinderungsgrund ohne Verschulden sein, der in der Person des Besch\u00e4ftigten liegt. In diesem Fall muss der Lohn f\u00fcr die Dauer der Verhinderung bezahlt werden.<br \/>\nHingegen gilt dies nicht, wenn der Besch\u00e4ftigte die M\u00f6glichkeit h\u00e4tte, den Arztbesuch ausserhalb der Arbeitszeit zu erledigen. Dies ist insbesondere bei Besch\u00e4ftigten in Teilzeit oder mit gleitender Arbeitszeit der Fall, die ihre Arbeitzeiten relativ selbst\u00e4ndig gestalten.<br \/>\nDie Unterscheidung zwischen diesen beiden F\u00e4llen ist nicht immer einfach. Institutionen k\u00f6nnen diesbez\u00fcglich interne Richtlinien f\u00fcr verschiedene Kategorien von Arbeitszeiten erlassen (vorgeschriebene oder flexible Arbeitszeit o. \u00e4.).<br \/>\nDie Richtlinien des Freiburger Amtes f\u00fcr Personal und Organisation (POA) und insbesondere jene betreffend Arztbesuch \u00abgelten weder unmittelbar noch sinngem\u00e4ss f\u00fcr die dem GAV INFRI-VOPSI unterstellten Besch\u00e4ftigten\u00bb.
